Labor protection system was built on subordinate or dependent work, that is on the historic archetype on which modern labor law has been built since the industrial revolution. The vast world of self-employment remained instead on the margins of labor law for a long time, on the assumption of the absence of a weak situation for the worker, so much so that it did not require particular protections. In this context, the construction and distribution of protections must be revisited considering the real needs for protection of the worker/person in the employment relationship and in the market. This approach is carried out in full implementation of national and supranational regulations, in the sense of giving emphasis to the different socio-economic conditions in which the work can be declined, to the different implication of the worker as a person in carrying out the service, to the quantity of the work carried out, etc. The method used is therefore not only the technical legal one, but also the empirical socio-economic one, in order to consider the real needs of the worker/weak-individual in the labor market/relationship.
