Il «polmone orientale» del sistema romano e il nuovo Codice civile cinese

The legal system founded on Roman law has created a complex legal tradition throughout history. In the West, this lexical, conceptual, and systematic heritage has mostly employed the linguistic technique of terminological calque, while in the East, it has employed semantic calque. This poses a critical issue in evaluating the dialogue between the Roman legal tradition and Chinese law in the Eastern Lung of the Roman system (adapting to Roman law the metaphor that the poet Ivanov expressed for Christianity).

Il sistema giuridico fondato sul diritto romano ha realizzato una complessa tradizione giuridica nella storia. In Occidente tale patrimonio lessicale, concettuale e sistematico ha utilizzato per lo più la tecnica linguistica del calco terminologico, mentre in Oriente quella del calco semantico. Ciò comporta una criticità nel ponderare il dialogo tra tradizione romanistica e diritto cinese nel Polmone d'Oriente del sistema romano (adeguando al diritto romano la metafora che il poeta Ivanov ha espresso per la cristianità).
