L’evoluzione della responsabilità degli Internet service providers: dalla direttiva e-commerce al Digital Services Act

The work reconstructs the legal framework governing the liability of Internet service providers as it has been shaped since from the e-commerce directive at the beginning of the second millennium to the today. It highlights how this has partly held up to the the changes that have taken place in the digital world, and in part has instead manifested its own limits, repeatedly probed and overcome thanks to the hermeneutic intervention of jurisprudence.

Il lavoro ricostruisce il quadro normativo relativo alla disciplina della responsabilità degli Internet services providers così come si è venuto plasmando a partire dalla direttiva e-commerce dell’inizio del secondo millennio, per giungere sino ai giorni nostri. Esso mette in evidenza come questo abbia in parte tenuto rispetto ai cambiamenti intervenuti nel mondo digitale, ed in parte abbia invece manifestato dei propri limiti, più volte sondati e superati grazie all’intervento ermeneutico della giurisprudenza.
