In the Italian judiciary system, the Corte di Cassazione is, at the same time, the highest institution of justice and judges of the contestation of sentences emanating from the primary and appellate courts. The Corte di Cassazione has the duty of overturning, at the behest of inquiring parties, sentences imposed by lower level judges who commit errors in the interpretation or application of the law. This analysis explores the theme relative to the sentence and implementation of the power of the Corte di Cassazione to overturn judgements from primary and appellate courts, made by mistranslations and misapplications of the law not brought to light by the interested parties. This analysis is composed of four chapters and an appendix. In the first chapter the fundamental concepts used in this analysis are established. The second chapter studies the practice of the actual decisions of the Italian Corte di Cassazione. The third chapter deepens the understanding of the fundamental characteristics of the justice precipitated in the Italian Corte di Cassazione, with particular attention paid to the widespread recognition of the civil codes of procedure of 1942, with their subsequent reforms in 1990 and 2006. The fourth chapter offers a prospective for a deeper understanding of the theme’s solution relative to the existence and conditions of the implementation of the power of the Corte di Cassazione to overturn previous judgements made with errors in interpretation or application of the law, however ignored by the involved parties. A last, the appendix discusses generally the theme of the power of la Corte di Cassazione, as well as an analysis of the most important European experiences (notably those of Germany and France).
