The article analyzes critically the evolution of the essential facilities doctrine from the stand point of both antitrust law and economic theory, following the evolution of competition. The final purpose of the analysis is to assess the adequacy of the current regulations of the access to the infrastructures and the need to adapt policies to the development of markets.
