The evolutionary historical connection between the powers of the pater familias in ancient Rome and the emergence of the category of "private property" is the result of an underlying ideological pressure that influenced studies on the subject until the first half of the twentieth century. In reality, a more careful reading of the sources (and thanks to the debate that emerged in the study of Roman law in the late twentieth century) reveals a fracture or discontinuity in the formation of the category of "dominium" in the second century BC (reinterpreted, in the late nineteenth century, as a precursor to the liberal category of private property).
Il collegamento storico in chiave di evoluzione tra i poteri del pater familias a Roma antica e la nascita della categoria della 'proprietà privata' è frutto di una pressione ideologica sotterranea che ha condizionato gli studi in materia fino alla prima metà del Novecento. In realtà, ad una lettura delle fonti più attenta (e grazie al dibattito emerso nella scienza di studio del diritto romano nel secondo Novecento) è possibile al contrario cogliere una frattura o discontinuità nella formazione nel II secolo a C. della categoria del 'dominium' (riletta, nel secondo Ottocento, quale prodromi alla categoria liberale della proprietà privata).
