The article analyzes the protection of occupational health and safety for remote workers (lavoro agile) following the reform introduced by Law no. 34 of 2026, which inserted paragraph 7-bis into Article 3 of Legislative Decree no. 81 of 2008. By relocating this matter within the Consolidated Law on Health and Safety (Testo Unico), the amendment overcomes the previous regulatory isolation and redefines the employer’s ‘duty of safety’ beyond a merely documentary dimension. The fulfillment of the risk information disclosure, backed by a stricter criminal sanctioning regime, assumes central evidentiary value within the framework of corporate compliance. The investigation focuses on the clause of ‘compatible’ obligations and the complex management of new-generation outdoor and psychosocial risks - such as technostress, isolation, and work-life blending - which can no longer be governed through the control of physical space, but rather through a ‘process-oriented’ safety model. The study highlights the risk of formalistic drifts and a surreptitious shifting of risk onto the employee, advocating for a valorization of cooperative compliance and the subsidiary role of collective bargaining.
L’articolo analizza la tutela della salute e sicurezza del lavoratore agile dopo la riforma della L. n. 34 del 2026, che ha inserito il comma 7-bis all'art. 3 del D.lgs. n. 81 del 2008 . Ricollocando la materia nel Testo Unico, la novella supera il precedente isolamento precettivo e ridefinisce il ‘debito di sicurezza’ datoriale oltre la dimensione meramente documentale. L'adempimento dell'obbligo informativo, assistito da un inasprito apparato sanzionatorio penale, assume una valenza probatoria centrale nell'assetto della compliance aziendale. L’indagine si sofferma sulla clausola degli obblighi ‘compatibili’ e sulla complessa gestione dei rischi outdoor e psicosociali di nuova generazione - quali tecnostress, isolamento e work-life blending - governabili non più tramite il controllo dello spazio fisico, ma attraverso una sicurezza ‘di processo’. Si evidenzia il rischio di derive formalistiche e di surrettizia traslazione del rischio sul lavoratore, auspicando una valorizzazione della cooperazione adempitiva e del ruolo sussidiario della contrattazione collettiva.
