The comment concerns the judgement of the European Court of Justice of 7 october 2004 in case C-247/02. The power to choose the award criterionto be applied in each public works tender must be consistent with the principle of achieving effective competition. In particular, in exercising its discretion the contracting authority should take into consideration the funds available to complete the project and should attempt to provide every bidder with the opportunity to introduce alternative project solutions wich might help achieve the best possible final product
