Dopo le Sezioni Unite: ancora qualche riflessione sulla rinuncia abdicativa alla proprietà immobiliare

The author returns to the topic of abandonment of real estate property following the ruling by the United Sections of the Court of Cassation, which definitively affirmed its admissibility. After a brief examination of the main arguments of the ruling and the reasons that further demonstrate its correctness, the author focuses on the draft law that aims to limit, albeit only de facto, the exercise of the power of renunciation, thereby neutralizing the principles of law affirmed by the Court of Cassation, in order to highlight its possible constitutional illegality.

L’autore torna ad affrontare il tema della rinuncia abdicativa alla proprietà immobi- liare dopo la sentenza delle Sezioni Unite della Cassazione che ne ha definitivamente affermato l’ammissibilità. Dopo una breve disamina delle argomentazioni principali della sentenza, e delle ragioni che ne dimostrano ulteriormente la correttezza, l’autore si sofferma sul disegno di legge che intende limitare, seppure solo in via di fatto, l’e- sercizio del potere di rinuncia, e così neutralizzare i principi di diritto affermati dalla Cassazione, per sottolinearne i possibili profili di illegittimità costituzionale.
