Regulation (EU) 2024/1689 laying down harmonised rules on artificial intelligence (AI Act) tries to balance two different el-ements: innovative experimentation and economic growth to spread AI in the internal market and to compete with other in-ternational players; protection of rights, freedoms and values which underpin the European integration process. In achieving this goal, the AI Act is a combination of light and shadow. The risk-based approach and the resulting rigid classification of AI systems may be inadequate to deal with algorithmic discrimi-nation and not resilient enough to keep up with the later devel-opments in AI. The success of Regulation (EU) 2024/1689 will have to be tested in practice, and will depend on the qualities of those empowered to apply and enforce it.
