The paper aims to provide some insights from a constitutionalist perspective with a view to contributing to the debate about the extent and effectiveness of the protection of mental well-being. After clarifying the constitutional notion of mental health, the essay focuses on critical profiles of the regulation of compulsory (and coercive) health treatment in psychiatry, with particular attention to its compliance with constitutional guarantees protecting personal freedom, the right to defense and the health freedom.
