Abstract

The criticism of current law aimed the limits of a owner-centric vision, in the sense that it places private property (as ius abutendi and ius excludendi) as a central legal scheme in the forms of belonging in contemporaneity. The historiography reconstruction has been oriented to grasp in terms of development and derivation the idea of dominium from the powers of the pater familias (or from one of them). Instead, a line of discontinuity is highlighted that will open new interpretative lines.
