Considerazioni sul rinvio nel trasporto aereo di persone tra normativa internazionale-uniforme, unionale e nazionale

The contribution analyses the problems arising from the «renvoi» to the content of the Montreal Convention of May 28, 1999 on the part of EC Reg. No. 2027 of 1997, as amended by EC Reg. No. 889 of 2002, or by the national law referred to in the Code of Navigation with particular regard to its Art. 941 c. nav. Particular attention is paid to the cases in which the discipline of the convention is extended to hypothesis not directly covered by it. This may occur when an event is not directly considered by the Montreal convention of May 28, 1999, or the requirements for the application of the convention or the corresponding European legislation are not present.
