The weakness of the position of the foreigner (from the point of view of his protection in rem against a Roman citizen) presents a strong imbalance, compared to the full protection in personam in relation to consensual contracts, based on bona fides. An extensive use of the actio Publiciana is also hypothesised for the foreigner (who is unable to usucapio) thanks of enjoying the fictio of the action, without temporal limits.
