La libertà dell'arte fra continuità e metamorfosi. Una prospettiva costituzionale

The aim of the monograph is to investigate the artistic phenomenon in its declination of constitutionally protected freedom. Starting from the recognition that the explicit provision of artistic freedom in the art. 33 of the Constitution is aimed at offering a strengthened guarantee to artistic expression - which, more than other manifestations of thought, is historically characterized by an irreverent and non-conformist character -, the further question that needs to be deepened concerns what makes “artistic” an expression of thought. To face this problem the legal categories are obviously incomplete, with the risk that art becomes weak to the different kinds of censorship, that, moreover, could come both from public authorities as well as private entities. Furthermore, the multiculturalism, which increasingly innervates contemporary societies, exposes artistic expression – when it throughs sensitive topics for morality or religion – to further conflicts, also radicalized by social media, that are multiplier of the interests of lobbies and groups. Nonetheless, from the “Net”, as well as from the very recent Artificial Intelligence systems, in constant development, arise further unexpected challenges, the outcomes of which are not easy to be forecasted.

Obiettivo del volume è indagare il fenomeno artistico nella sua declinazione di libertà costituzionalmente protetta. A partire dal riconoscimento che l’esplicita previsione della libertà d’arte nell’art. 33 della Costituzione sia volta ad offrire una garanzia rafforzata all’espressione artistica – che, più di altre manifestazioni del pensiero, è storicamente connotata da un carattere dissacrante e anticonformistico –, l’ulteriore interrogativo con cui è necessario confrontarsi riguarda cosa renda “artistica” una espressione del pensiero. Una problematica, questa, di fronte alla quale le categorie giuridiche scontano, com’è evidente, una inevitabile incompletezza, con il rischio di rendere l’arte più vulnerabile di fronte alle diverse forme di censura, le quali, peraltro, possono provenire tanto dai pubblici poteri quanto dai soggetti privati. Inoltre, la multiculturalità che innerva sempre più intensamente le società contemporanee espone l’espressione artistica – laddove essa si avventuri su terreni particolarmente sensibili per la morale o la religione – ad ulteriori conflitti, radicalizzati anche in conseguenza dell’effetto moltiplicatore ed aggregatore delle comunità di interessi prodotto dai social media. Nondimeno, proprio dalla “Rete”, nonché dai recentissimi sistemi di Intelligenza Artificiale, in costante sviluppo, giungono ulteriori, inattese sfide, i cui esiti paiono al momento non compiutamente pronosticabili.
