Eredi legittimi e designazione dei beneficiari nelle assicurazioni sulla vita

Starting from the analysis of the life insurance “in favor of a third party” offered by the Supreme Court, the paper recalls the results achieved by the jurisprudence and the doctrine on the specific issue of the identification of beneficiaries, based on the “legitimate heirs” clause pursuant to the art. 1920, paragraph 2, c.c.

Partendo dalla ricostruzione dell’assicurazione sulla vita « a favore di un terzo » offerta dalla Corte di cassazione, la nota richiama i risultati raggiunti dalla giurisprudenza e dalla dottrina sulla tematica specifica della individuazione dei beneficiari, in base alla clausola « eredi legittimi » ai sensi dell’art. 1920, comma 2, c.c.
