The essay, developing the thought of Mario Allara, examine the hypotheses of revocation of testamentary dispositions with voluntary destruction, laceration or cancellation of the will ex art. 684 of the Italian civil code. The contribution criticizes the restrictive setting of the hypotheses governed by art. 684 of the civil code : the conduct of the de cuius is identified as material act and not as a general juridical act for a per facta concludentia. The essay underlines the need to ascertain the ablative will of the testator as a fundamental principle of private law according to the individual concrete case.
