Justinian intervenes strongly on the theme of disinheritance in Nov. 155, allowing it when its causes substantially coincide with the typified cases of unworthiness to suc-cession. On the latter aspect, moreover, a tension towards a functionalisation of the succession is discernible in two cases; that is, not only the unworthy heir is punished by being deprived of the inheritance, but the latter is attributed to those who have been (or will be) of assistance to the testator.
