Legal thought in recent centuries has strongly oriented itself towards the centrality of the role of the 'will' of the 'subject of law', a legal structure functional to the neo-liberal society, constructing error as a unitary category relevant in terms of invalidity of the legal transaction. That is, the category of error is emancipated from its specific contexts of relevance, within the typical figures, and instead becomes itself a category, equipped with its own regime which increasingly tends to emerge in the context of the problem of negotiation invalidity. From this point of view, it is a privileged perspective for reading the interpretative and methodological mechanisms that characterized legal studies in Europe in the 19th century, in the phase of construction of a new system of private law in Germany.
Il pensiero giuridico degli ultimi secoli si è orientato con forza verso la centralità del ruolo della ‘volontà’ del ‘soggetto di diritto’, struttura giuri- dica funzionale alla neo-società liberale, costruendo l’errore come categoria unitaria rilevante in chiave di invalidità del negozio giuridico. La categoria dell’errore si emancipa, cioè, dai suoi contesti specifici di rilevanza, all’interno delle figure tipiche, e diviene, invece, esso stesso una categoria, dotata di un proprio regime che tende sempre di più a delinearsi nel- l’àmbito del problema della invalidità negoziale. Da questo punto di vista, si tratta di un occhiale privilegiato per leggere i meccanismi interpretativi e metodologici che hanno caratterizzato gli studi giuridici in Europa nel XIX secolo, nella fase della costruzione in Germania di un nuovo sistema del diritto privato.
