The emergency caused by the Covid-19 pandemic has inevitably also involved the criminal justice system. Virus containment measures were quickly launched, through multiple provisions, under approximately different written profiles. The multiple instances to which emergency legislation is called upon, however, are ill-suited to neutralizing the risk of an epidemic inside prisons, as well as to the canons of the criminal trial. However, the emergency provisions must respect the fundamental rights of the protagonists of the criminal trial, so that exceptional regulatory interventions can be justified exclusively in compliance with the constitutional principles, and for a short period, without any possibility of progressive consolidation of the derogation from the principles of the fair trial.
