The transitional rules on the enforcement of pecuniary penalties provide that the new legislation applies, as a rule, only to acts committed after the entry into force of the reform. The intention is to respect the constitutional principle of non-retroactivity and to safeguard the organisational needs of the supervisory judges in the face of the foreseeable increase in its workload. Consequently, with reference to previously committed offences, the pre-existing system remains unaltered, subject to the need to make the new substantive rules retroactive where, in practice, they are more favourable. Problematic, however, are the relations between this discipline and the faculty, included in Article 86, par. 1-bis, disp. att. c.p.p., to use the modalities provided for pecuniary penalties to enforce the value-based confiscation of assets not subject to seizure (or, however, not specifically identified).
Nel tracciare la disciplina transitoria in materia di esecuzione delle pene pecuniarie, il legislatore delegato ha reso normalmente applicabile il rinnovato assetto ai soli fatti commessi dopo l’entrata in vigore della riforma; ciò sia per rispettare il canone costituzionale dell’irretroattività in peius, sia per rispondere alle esigenze organizzative della magistratura di sorveglianza, a fronte del prevedibile incremento del relativo carico di lavoro. Sicché, con riferimento ai reati precedentemente consumati, resta inalterato il preesistente impianto, salva la necessità di far retroagire le nuove norme di matrice sostanziale ove, in concreto, più favorevoli. Problematici sono, tuttavia, i rapporti tra la trama così coniata e la facoltà, inserita nell’art. 86, comma 1-bis, disp. att. c.p.p., di ricorrere alle modalità previste per le pene pecuniarie per eseguire la confisca di valore di beni non sottoposti sequestro (o, comunque, non specificamente individuati).
