Rileggendo Tolstoj: a proposito di guerra, diritto e Costituzione

The war in Ukraine, and Italy's involvement as well, stimulates reflections on the relationship between war and law and induces the question of whether, beyond the limits set by Article 11 Constitution, it is still possible to recognize the legitimacy of the category of "just war." Through reading Tolstoy's short stories and novels, the conclusion is reached that no war can ever be just.

La guerra in Ucraina, e il coinvolgimento anche dell’Italia stimola riflessioni sui rapporti tra guerra e diritto e induce a chiedersi se, al di là dei limiti fissati dall’art 11 Costituzione, sia ancora possibile riconoscere la legittimità della categoria della “guerra giusta”. Attraverso la lettura di racconti e romanzi di Tolstoj si perviene alla conclusione che nessuna guerra può mai essere giusta.
