The paper focuses on the question of social services to foreigners, highlighting the great influence that both the Court of Justice of European Union and the European Court of Human Rights have over national jurisprudence. More than anything the Author draws attention to the problematic condition of residence, that could be used as incisive instrument of discrimination in the provisions on social security benefits. Concerning that point, the paper focuses on some recent rulings of the Constitutional Court, that arrives at not really convincing conclusions.

Abstract

The paper focuses on the question of social services to foreigners, highlighting the great influence that both the Court of Justice of European Union and the European Court of Human Rights have over national jurisprudence.
