The following essay aims to address the legal status of beggars and, more generally, of the indigent populations of France between the Old Regime and the Revolution. From the study of normative sources, as well as legal and political practices and discourses, a greater continuity emerges between the two eras compared to what historiography has traditionally maintained. However, in this continuity, caesuras emerge that open new horizons of meaning in European constitutional history. Although, there is a persistence with the practices of the Old Regime, the revolutionary period and in particular the Jacobin moment was characterized by an attempt to get out of the paternalistic and moralistic paradigm and open new possibilities to overcome poverty, especially through the right to work.

El siguiente ensayo pretende abordar la condición jurídica de los mendigos y, más en general, de las poblaciones indigentes de Francia entre Antiguo Régimen y Revolución. Del estudio de las fuentes normativas, así como de las prácticas y discursos jurídicos y políticos, surge una mayor continuidad entre las dos épocas comparado con lo que la historiografía ha sostenido tradicionalmente. Sin embargo, en esta continuidad surgen cesuras que abren nuevos horizontes de sentido en la historia constitucional europea. Si bien, existe una persistencia con las prácticas del Antiguo Régimen, el periodo revolucionario y en particular el momento jacobino se caracterizó por un intento de salir del paradigma paternalista y moralista y abrir nuevas posibilidades de superación de la miseria especialmente a través del derecho al trabajo.
