From the legal servitude of via to the parties’ agreement on iter and actus: a reflection on lex, interpretatio and the docu- ments of praxis. When dealing with the praedial servitudes of passage, the documents of the praxis confirm the results emerging from the works of the jurists. The praxis has created, alongside the legislative servitude of via, the two new servitudes of iter and actus, which the jurists will define as iura in re aliena. However, the praxis retains for some time the older proprietary model also for these new servitudes with forms of precarious and individual concession. This partial difference between the inter- pretation of the jurists and the praxis provides useful elements for the overall reconstruction of the system of servitudes.
