L’indagine sui poteri normativi delle autorità amministrative indipendenti nel sistema delle fonti del diritto si compone di tre capitoli ed un’appendice. Il primo capitolo è dedicato all’approfondimento del fenomeno giuridico delle c.d. “authorities” nella prospettiva di una (possibile) delimitazione della relativa nozione. Quest’ultima viene ricostruita intorno a due profili: quello ‘soggettivo’ (l’indipendenza delle autorità dal circuito democratico rappresentativo) e quello ‘oggettivo’ (la funzione di tutela di valori costituzionali ad esse affidata). Quanto al primo, vengono evidenziati i meccanismi che il legislatore ha adottato per garantire loro l’indipendenza “organizzativo-strutturale” e quella “operativo-funzionale”. L’analisi del profilo ‘oggettivo’, passando attraverso lo studio delle principali cause che hanno indotto il Parlamento all’istituzione di autorità indipendenti, giunge ad enucleare la funzione che esse hanno nell’ordinamento: il contemperamento dei valori costituzionali in tensione tra loro. Dopo aver affrontato alcuni nodi problematici riguardanti la quantità e la qualità dei poteri di cui sono dotate le authorities (il rapporto con il principio di separazione dei poteri, la tesi della c.d. “para-giurisdizionalità”, il tema della legittimazione e della responsabilità), la trattazione si concentra sull’analisi dei poteri normativi e c.d. “para-normativi” delle autorità indipendenti e, posto il differente trattamento giuridico che nel nostro ordinamento gli atti normativi ricevono rispetto agli altri atti giuridici (l’atto amministrativo, la sentenza, il contratto), precisa i criteri di individuazione della normatività adottati nell’indagine (essenzialmente, generalità, astrattezza e pubblicazione necessaria). Il secondo capitolo illustra, per ognuna delle autorità indipendenti, i poteri normativi volti a disciplinare l’organizzazione, il personale, la contabilità e le procedure, mettendo in evidenza la residualità del concetto di norma c.d. “interna”, generale ed astratta ma costitutiva di un ordinamento particolare, rispetto a quello di fonte del diritto oggettivo, produttiva di norme rilevanti nell’ordinamento giuridico generale e, pertanto, soggetta al regime della pubblicazione necessaria. In tale prospettiva, l’indagine sottolinea come i regolamenti di auto-organizzazione delle autorità indipendenti, ed in particolare quelli aventi ad oggetto i procedimenti secondo cui le stesse agiscono, contribuiscano alla dissoluzione degli ordinamenti interni nell’ordinamento giuridico generale. Infine, viene affrontato il tema della compatibilità dei predetti regolamenti con la riserva di legge prevista dall’art. 97 della Costituzione in materia di organizzazione della pubblica amministrazione. Il terzo capitolo analizza, anzitutto, gli atti normativi con cui le autorità indipendenti disciplinano il settore cui sono preposte, soffermandosi, per ognuna di esse, non solo su quegli atti espressamente definiti dalle leggi quali ‘regolamenti’, ma anche su quelli che, pur definiti diversamente (delibere, disposizioni, direttive, istruzioni, provvedimenti, etc.), hanno contenuto “sostanzialmente” regolamentare e, dunque, si pongono quali vere e proprie fonti del diritto obiettivo. In particolare, vengono analizzate alcune manifestazioni di normatività particolarmente eccentriche: ad esempio, le istruzioni di vigilanza della Banca d’Italia, i provvedimenti generali dell’ISVAP, la provvisoria regolamentazione delle prestazioni indispensabili da parte della Commissione di garanzia sullo sciopero nei servizi pubblici essenziali, i provvedimenti determinativi delle tariffe dell’Autorità per l’energia elettrica e il gas (AEEG), i codici deontologici e le autorizzazioni generali previsti dal codice in materia di protezione dei dati personali (d.lgs. n. 196/2003). In secondo luogo, la ricerca tratta di quei poteri e di quegli atti delle autorità indipendenti che, pur non potendo essere qualificati come normativi (di qui l’uso del termine ‘para-normativi’), hanno comunque la funzione di indirizzare e conformare il comportamento dei soggetti regolati: le circolari dell’ISVAP, le determinazioni e gli atti di regolazione dell’Autorità per la vigilanza nei lavori pubblici, le linee guida dell’AEEG e dell’Autorità per le garanzie nelle comunicazioni (AGCOM), la partecipazione di alcune autorità alla c.d. “auto-normazione privata” (ad es., della CONSOB, della Commissione di garanzia sullo sciopero e dell’AGCOM) e, infine, la funzione propulsiva che le authorities svolgono in relazione alla produzione normativa degli organi costituzionali. In conclusione, il capitolo affronta alcuni profili problematici riguardanti i poteri normativi delle autorità indipendenti: il rispetto del principio di legalità e della riserva di legge, il rapporto tra gli atti normativi delle authorities e le fonti del diritto statale di rango primario e secondario, l’incidenza della loro presenza sulla forma di governo parlamentare e, infine, i problemi che pongono in rapporto alle autonomie regionali di cui al nuovo Titolo V della Costituzione. L’appendice posta alla fine della ricerca si sofferma, anzitutto, sulle novità che il progetto di revisione costituzionale all’esame del Parlamento (A.S. n. 2544-B) dovrebbe introdurre per le autorità indipendenti, tra l’altro, sotto il profilo della “copertura costituzionale” che esse riceverebbero. In secondo luogo, analizza la previsione, contenuta nel disegno di legge a tutela del risparmio (A.S. n. 3328), per la quale gli atti normativi e generali delle autorità indipendenti “finanziarie” dovrebbero essere, da un lato, accompagnati da un’adeguata motivazione, d’altro lato, adottati previa consultazione dei soggetti interessati. The first chapter is an in-depth analysis of the so-called “authorities” which aims at clarifying (as well as possible) the very concept of “authority”. The latter is defined along two different lines of investigation: the first focuses on the ‘subjective’ dimension of the “authorities” (their independence from political-representative institutions), the second assesses their ‘objective’ aspect (their function as guardians of constitutional values). As far as the ‘subjective’ dimension is concerned, this study brings to light the mechanisms created by the legislator to guarantee the organisational, as well as the functional, independence of the “authorities”. Following an examination of the major causes that brought the Parliament to create such independent bodies, the analysis of the ‘objective’ aspect aims at defining the function that they have in the legal system: to maintain the balance between constitutional values which seem to clash with each other. After a study of the most problematic issues concerning the quantity and quality of the authorities’ powers (i.e. the relationship with the principle of the division of powers, the theme of so-called “quasi-judicial powers”, and the issues of legitimation and responsibility), the thesis focuses on the analysis of the independent authorities’ normative and “quasi-normative” powers. Given the different juridical treatment reserved in Italy for normative acts on the one hand and for other legal acts on the other (i.e. administrative acts, contracts and sentences), this work delineates the criteria which the norms have been identified with in this investigation (generality, abstractness and compulsory publication). The second chapter illustrates, for each independent authority, the normative powers that aim at regulating their organization, human resources, accountancy and procedures. It then highlights the residual aspects revealed by so-called “internal norms” (both general and abstract, but constitutive of a special legal system), when compared to the concept of source of law, which produces relevant norms in the general legal system, and therefore is subject to compulsory publication. From this perspective, this study underlines to what extent the regulations for the independent authorities’ self-organization, and in particular the regulations on their procedures, contribute to the dissolution of the internal legal systems into the general one. Finally, this study deals with the compatibility of regulations considered above and the reserve of law provided by art. 97 of the Constitution with regard to the organization of the public administration. The third chapter analyses, first of all, the normative acts chosen by the independent authorities to regulate the sectors within their competence. Particular attention is devoted not only to those acts that are clearly defined by the law as ‘regulations’, but also to those, otherwise defined (resolutions, dispositions, directions, instructions, measures, etc.), whose content is “basically” normative and therefore act as actual sources of law. More in detail, the thesis analyses some particularly eccentric manifestations of normativeness, i.e. the vigilance instructions of the Bank of Italy, the general measures of ISVAP, the temporary regulation of the indispensable service of the Commission of guarantee on strikes in essential public services, the measures taken by the Authority for electric energy and gas (AEEG) to determine fares, the deontologycal codes and the general authorizations provided by the code on the protection of personal data (d.lgs. n. 196/2003). Furthermore, the study investigates those powers and those acts of the independent authorities that cannot be considered normative (hence the term “para-normative”) and yet direct and conform the behaviour of the regulated subjects: i.e. the ISVAP’s circulars, the determinations and the acts of regulation of the Authority for the vigilance of public works, the guidelines of the AEEG and of the Authority for the guarantee of the communications (AGCOM), the participation of some authorities in so-called “private self-regulation” (for example, that of the CONSOB, of the Commission of guarantee on strikes and of the AGCOM), and finally the propulsive function that the authorities have towards the constitutional bodies’ normative production. To conclude, the chapter tackles some problematic aspects concerning the independent authorities’ normative powers: i.e. the respect of the rule of law and of the reserve of law, the relationship between the authorities’ normative acts and the sources of national law of first and secondary rank, the incidence of their presence on actual parliamentary form of government and, finally, the problems that arise when they interact with the regional self- government provided by the new Title V of the Constitution. The appendix focuses mainly on the novelties that the project of a constitutional review under exam by Parliament (A.S. n. 2544-B) should introduce with regard to the independent authorities and, among other things, to the “constitutional covering” that they would receive. Secondly, the appendix analyses the provision, included in the bill on the protection of savings (A.S. n. 3328), according to which the independent financial authorities’ normative and general acts should be, on the one hand, accompanied by adequate motives and, on the other hand, embraced only after consultations with the subjects involved.

Abstract

L’indagine sui poteri normativi delle autorità amministrative indipendenti nel sistema delle fonti del diritto si compone di tre capitoli ed un’appendice. Il primo capitolo è dedicato all’approfondimento del fenomeno giuridico delle c.d. “authorities” nella prospettiva di una (possibile) delimitazione della relativa nozione.
