The prohibition for women to drink wine is in the studies of Roman law usually referred to a lex Romuli. There are, however, reasons to believe that it was rather prescribed by the mos maiorum, and that the rule had a judicial origin. The sources that speak of a lex seem to depend on the Augustan and imperial legislation.
