A public administration, having unlawfully occupied a private area and constructed a public work, may legitimately acquire the aforesaid area in two different ways: by stipulating a contract with the owner of the area; by adopting a new formal procedure aimed at the expropriation of the area itself. Moreover, according to art. 42 bis L. n. 327/2001, the public administration may also acquire private areas, which had been unlawfully occupied and used in the public interest, by compensating the owner of the damage he suffered.

Abstract
