CORTE COSTITUZIONALE E DISCREZIONALITÀ LEGISLATIVA IN MATERIA PENALE. SPUNTI E PROSPETTIVE NELLA RELAZIONE DEL PRESIDENTE SULLA GIURISPRUDENZA DEL 2018

Il contributo ripercorre le tappe principali della Relazione del Presidente Lattanzi sulla giurispru- denza costituzionale del 2018, mettendone in evidenza, nella dimensione penalistica, gli snodi più significativi e le innovazioni principali nei rapporti fra Corte costituzionale e legislatore. In que- st’ottica, l’attenzione è rivolta in particolare agli strumenti decisori inaugurati nell’ultimo anno, ai limiti e ai margini del sindacato in malam partem e alle prospettive di maggiore rigore che, traendo spunto dall’incidenza del diritto europeo e della relativa giurisprudenza sull’ordinamento interno, si schiudono, anche a livello nazionale, nel vaglio sulla sufficiente determinatezza delle norme penali. This contribution traces the main parts of President Lattanzi’s Report on 2018’s constitutional jurisprudence, highlighting the most significant points and the primary innovations in the relations between the Constitutional Court and the legislature in criminal law. In this perspective, the focus is, in particular, on the decision-making tools inaugurated over the last year, namely on the limits and margins of the Court in malam partem and on the prospects of greater rigor which, by taking notice of the effect that European law and its relative jurisprudence has on the internal system, encourage, also at the national level, an assessment of the sufficient certaintly of the criminal laws.
