Abstract

The earliest manuals of Roman law in Chinese date back to before the foundation of the People’s Republic of China in 1949. Only after 1978, the renewed interest in these issues led to the publication of new teaching manuals on Roman law. Roman law courses have been set up in China since 1912. Over the last 40 years, the growth in the number of law faculties in the People’s Republic of China has been impressive. The spread of teaching materials allowed Chinese scholars to learn how Italian professors organize the teaching of Roman law in Italy and how they split Roman Law course into History of Roman Law and Institutions of Roman law. Currently, Roman law courses in China are still optional; furthermore, compared to the past, the number of teaching hours provided has not increased; apart from a few rare exceptions, the teaching of Roman Public law is excluded from courses. What’s common among all Roman law courses is the method of analysis of legal instruments, principles and rules of Roman law, which combines the use of manuals with the use of Roman sources translated in chinese, also with the aim to develop analytical capacity and critical thinking.
