Adprehensio rei e “buona fede” del terzo

It is known that confiscation does not prejudice the rights of bona fide third parties. However, it can not be ignored that the procedure against the third party is not surrounded by guarantees similar to those reserved to the accused. From this point of view, the new rule concerning the citation of the third party in the trial should be welcomed, even though it is still confined to the case of freezing measures for the purposes of subsequent «enlarged confiscation» and formulated to leave ample space for the interpretation of jurisprudence.

Se è principio generale che la confisca non pregiudica i diritti dei terzi in buona fede, non si può trascurare, però, che la tutela processuale di questi ultimi non è contornata da garanzie analoghe a quelle dell’imputato. In quest’ottica, è apprezzabile la regola che impone la citazione del terzo durante il giudizio di cognizione, confinata tuttavia all’evenienza di sequestro funzionale alla «confisca allargata» e formulata in modo da lasciare ampio spazio all’interpretazione creativa.
