Le “novità” introdotte dalla legge sulle unioni civili e la disciplina del matrimonio

The essay analyses the new provisions introduced by the Italian statute on civil partnerships, showing awareness of the supranational dimension in the current Italian legal system. The research investigates whether these new pro- visions could influence the Italian marriage law, in particular the provisions on the surname and on the divorce, taking into account the principles of the European family law. The author argues that the introduction of the surname of both partners and of the divorce without the consent of one of the spouses shows that the barycentr of the institution of marriage is shifting towards the private autonomy.

Il lavoro, muovendo dalla consapevolezza dell’attuale assetto ordinamentale, arricchito della sua dimensione sovranazionale, analizza le novità introdotte dalla legge sulle unioni civili e verifica le possibili ricadute sulla disciplina del matrimonio, con riferimento, in particolare, alla disciplina del cognome e a quella dello scioglimento del rapporto matrimoniale. Secondo l’a. l’introduzione del cognome comune e dello scioglimento unilaterale, più che elementi di specialità delle unioni civili, potrebbero porsi quali ulteriori tasselli al disegno di spostamento del baricentro del matrimonio verso l’autonomia privata.
