The advent of Modernity has determined a vast process of re-organisation of culture. That “epochal” revolution changed the ratio between the I and the world; it modified the bond be- tween reason and experience, and it also redefined the relationship between natural language and universal language. Simultaneously, it caused a radical juridical twist, thus outlining a new relationship between rules and reality, between being and ought to be, between certainty and justice. Despite the great achievements of Modernity, despite its evident efforts to set the I in the centre and the world in the periphery, the discussion on law was born and developed under the sign of possessive individualism. On the other hand, both claims of Modern Era – the only law is the private law/public law is the only law – cannot explain the infinite juridical nuances. As a result, today justification of law’s obligatory has to be able to integrate the fundamental achievements of the modern world with the essential principles of civil life – such as solidarity, for instance – which Modernity itself has often shunned or denied in the past.
L’avvento della Modernità ha determinato un immenso processo di riorganizzazione della cultu- ra. Questa rivoluzione, effettivamente “epocale”, ha cambiato il rapporto Io-mondo, ha modifica- to il legame tra ragione ed esperienza, ha ridefinito la relazione tra linguaggio naturale e lingua universale. Al contempo, ha prodotto un forte cambiamento nel mondo del diritto, delineando un nuovo rapporto tra norma e realtà, essere e dover essere, certezza del diritto e giustizia. Non- ostante le grandi conquiste della modernità, nonostante il suo evidente sforzo per collocare l’io al centro e il mondo in periferia, il discorso giuridico è nato e si è sviluppato sotto il segno del- l’individualismo possessivo. D’altronde, entrambe le pretese dell’epoca moderna – il diritto è so- lo diritto privato/il diritto è solo diritto pubblico – non riescono a dare conto delle infinite sfuma- ture di cui si compone la giuridicità. Per questo motivo, l’odierna giustificazione della obbligato- rietà delle norme deve essere in grado di integrare le fondamentali acquisizioni del moderno con quei princìpi essenziali del vivere civile – come, ad esempio, la solidarietà – che la stessa mo- dernità ha messo tra parentesi e rinnegato.
