When a preventive seizure is ordered in relation to a possible future confiscation, neither the “fumus boni iuris” nor the “periculum in mora” is requised. In this way the measure turns to be an advanced sanction, in contradiction whit the right to be presumed innocent until proven guilty.
La materia cautelare imporrebbe fumus boni juris e periculum in mora, regola valida anche per le misure reali. Il sequestro preventivo disposto in attesa della confisca si sottrae ad entrambi i requisiti: la lacuna del legislatore e l’assenza di un aggiustamento giurisprudenziale trasformano la misura in un anticipo punitivo, in difformità alla presunzione di non colpevolezza.
