APPUNTI SUGLI ELEMENTI COSTITUTIVI DI UN’OPERAZIONE ECONOMICA

The expression "economic operation" includes a combination of elements (transactions, legal acts, etc.) aimed at achieving specific effects. This combination cannot be considered as a unitary act, nor as an atypical mixed transaction. The effects that derive from each individual act are not intended only in and of themselves, but also insofar as they contribute to realize the overall effects that arise at the end of the sequence. As a result, if the combination of the final effects is considered unlawful, then also every singly act must be considered to have an unlawful cause, and therefore it is void.

L’espressione “operazione economica” indica una combinazione di elementi (negozi, atti giuridici in senso stretto, etc.), mirata a conseguire determinati effetti. Questa combinazione non può considerarsi come un macro-atto unitario, né come un negozio misto atipico. Gli effetti che derivano da ogni singolo atto non sono voluti soltanto in sé e per sé, ma anche in quanto concorrono a realizzare gli effetti complessivi che scaturiscono al termine della sequenza. Da ciò discende che se la combinazione degli effetti finali sarà illecita, ogni atto negoziale posto in essere dovrà considerarsi illecito sotto il profilo della causa, e quindi nullo.
