The judgment no. 169 of 2015 declares the unconstitutionality of art. 5, paragraph 1-ter of d.-l. n. 47 of 2014, that, in breach of Article 136 of the Constitution, were aimed at (temporarily) restoring the effectiveness of certain rules which were repealed by the previous sent. no. 50 of 2014. The comment points out that, in the light of the recent constitutional case law, the constraints resulting by the rules regulating the effectiveness of the judgments of unconstitutionality are rigidly interpreted when, as in this case, are opposed to the legislature, but become much more blurred when the Constitutional Court deals directly with them.
La decisione n.169 del 2015 dichiara la illegittimità costituzionale dell’art. 5, comma 1-ter, del d.-l. n. 47 del 2014, che, in violazione dell’art. 136 Cost., intendeva ripristinare (temporanemante) l’efficacia di alcune norme annuallate dalla precedente sent. n. 50 del 2014 e dunque in contrasto con l’art. 136 Cost. Il commento mette in luce come, alla luce della recente giurisprudenza costituzionale, i vincoli derivanti dalle norme che disciplinano l’efficacia delle sentenze di illegittimità costituzionale siano rigidamente interpretati quando, come nel caso di specie, siano opposti al legislarore, ma divengono molto più sfumati quando è la stessa Corte cosituzionale a confrontarsi direttamente con essi.
