El concepto de sindicato mas representativo en Italia

The article analyzes the difficult balance that exists in the Italian labor law between freedom of association and selection of the "more representative" trade union . For this reason, the article examines the criteria which, over the years, have identified the "more representative" trade unions and their protection both in the private and public sector. In the end is underlined the overcoming of this requirement and the favor of the legislator accorded to the most representative trade unions in professional category.

L’articolo analizza il difficile equilibrio che si registra nell’ordinamento giuslavoristico italiano tra libertà sindacale e selezione del sindacato «maggiormente rappresentativo». A tal fine sono esaminati i criteri con cui, negli anni, si sono individuati i sindacati «maggiormente rappresentativi» e la loro tutela, sia settore nel privato che in quello del lavoro pubblico. Da ultimo si evidenzia il superamento del requisito della maggiore rappresentatività e il sostegno del legislatore ai sindacati più rappresentativi nella categoria.
